1. Acceptance of Terms
By accessing and using http://lumikaistudio.com (“Website”), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by these terms, please do not use this service.
2. Intellectual Property Rights
Original Works: All original manga, illustrations, characters, storylines, logos, and graphics created by Lumikai Studio are the exclusive intellectual property of Lumikai Studio. Unauthorized commercial use is strictly prohibited.
Fan Art: Works labeled as “Fan Art” are created as artistic tributes. Lumikai Studio owns the artistic rendition, but the underlying intellectual property (characters, worlds) belongs to their respective copyright holders. These works are not for sale.
3. Ownership of Materials
Possession of a digital copy of an image (e.g., downloading a file) does not constitute a transfer of rights. You do not own the copyright to any content simply by viewing, saving, or commissioning it, unless specifically stated in a separate contract.
4. Permitted Use
You are granted a limited, revocable license to access and use the Website for personal, non-commercial purposes. You may share links to our content on social media, provided that proper credit is given to Lumikai Studio.
5. Prohibited Uses (AI & NFT)
The following actions are strictly prohibited to protect our artists:
- No AI Training: Using our content to train Artificial Intelligence (AI) or machine learning models is prohibited.
- No NFT Minting: You may not use our art to mint Non-Fungible Tokens (NFTs).
- No Alterations: You may not edit, color-grade, or remove signatures from our artwork.
6. Artist Privacy & Safety
Lumikai Studio prioritizes the safety of our creative team. Users agree not to attempt to uncover personal identities or private contact information (“doxxing”) of any artist working under a pseudonym. Harassment of artists via comments or email will result in an immediate ban.
7. Moral Rights
Lumikai Studio and its constituent artists assert their Moral Rights to be identified as the authors of their respective works. Even when commercial usage rights are licensed, artists retain the right to display the work in their personal portfolios for self-promotion.
8. Commercial Engagements
For commissioned projects, a separate Service Agreement supersedes these general Terms. In the absence of a contract, Lumikai Studio retains all rights until full payment is received. Upon payment, rights are transferred only to the extent agreed upon in the invoice.
9. User Conduct
By posting comments, you agree that your content will not be unlawful, threatening, abusive, defamatory, or constitute hate speech. We reserve the right to remove any content that violates these standards.
10. Third-Party Links
Our Website may contain links to third-party websites. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party web sites.
11. Disclaimer of Warranties
This site and its components are offered for informational and portfolio purposes only. This site shall not be responsible or liable for the accuracy, usefulness, or availability of any information transmitted or made available via the site.
12. Indemnification
You agree to indemnify, defend and hold harmless Lumikai Studio from any liability, loss, claim and expense (including reasonable attorney’s fees) related to your violation of this Agreement.
13. Forensic Proof & Asset Protection
Strict Custody of Source Files: Lumikai Studio retains exclusive custody of detailed, multi-layered source files (e.g., .PSD, .CLIP, .TIFF) for every artwork produced. These files serve as irrefutable digital forensic proof of authorship. The unauthorized possession, distribution, or leakage of these layered versions is explicitly prohibited and will be subject to aggressive legal enforcement and immediate litigation.
Traceable Metadata & Assets: The artistic templates, custom brushes, textures, and 3D models used by Lumikai Studio are proprietary and contain embedded, traceable metadata. Any external work detected utilizing these proprietary assets without a valid license will be identified through forensic analysis, and the infringing parties will be judicially prosecuted to the fullest extent of the law.
14. Copyright Complaints (DMCA)
If you believe that your work has been copied in a way that constitutes copyright infringement within our content, please provide us with a description of the copyrighted work and the location of the infringing material via email.
